Kinoma Website Privacy Policy

This Kinoma Website Privacy Policy (“Privacy Policy”) provides information about how we at Marvell Semiconductor, Inc. (“we,” “us,” “our”, or “Kinoma”) collect, use, and transfer your data with our web sites (including http://kinoma.com/) (collectively, the “site”), but only those web sites on which we post a direct link to this Privacy Policy.

 

Scope of this Privacy Policy

  • Except as otherwise described below, this Privacy Policy covers only data collected through the site by us.
  • This Privacy Policy does not cover data collection by any other entity.
  • Occasionally, we may request consent from you for special purposes; under such circumstances, this Privacy Policy applies as modified in the particular notice or request for consent.
  • We are not responsible for the practices employed by websites linked to or from our websites, nor the information or content contained therein.
  • Please remember that when you use a link to go from the site to another website or app, our Privacy Policy is no longer in effect and your browsing and interaction there is subject to that website or App's own rules and policies.

Types of Data Collected and How It Is Collected

Information you submit. When you request information, subscribe for a service, register as a user, respond to an online survey, send us an email or other communication, or otherwise actively send us data, we collect data such as: your name, email address(es), mailing address(es), telephone number(s), and certain information related to the business you represent (if applicable). In connection with services that require a payment, we will also collect payment information (e.g., credit card number and related verification information). Information we automatically collect. As part of the standard operation of the site, we may collect information from your computer or mobile device, including but not limited to your operating system, browser type, IP address, and web request. Where We Store and Process Data

We keep data in various locations in the state of California, and the Kinoma and Marvell group of companies also has servers, contractors and employees around the world in various locations, including, without limitation, other parts of the United States of America, Asia and the European Economic Area.

Disclosures of Personal Information

We do not sell or rent your information to telemarketers and do not share your personally identifiable information with others, except as follows:

  • We freely share your information within Kinoma and our wholly owned affiliated entities.
  • We also share your information with agents and service providers who use the data only on our behalf.
  • Certain parts of our site may offer services or information specific to partners or customers (such as specific services for developers) and in such cases, we may share your personal information and activities on our site with those partners or customers for their business use.
  • Except as otherwise described in this Privacy Statement, we will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use [Kinoma: please link], take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and (c) to exercise or protect the rights, property, or personal safety of ourselves, our users or others.

We will usually be glad to update or amend your information for most requests, but we reserve the right to use information obtained previously to verify your identity or take other actions that we believe are appropriate.

Security

  • Transmissions over the Internet can never be completely secure or error-free. However, we take reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, and alteration.
  • It is your responsibility to keep secret any password and User ID you use to access the sites and to notify us by emailing privacy@kinoma.com if you ever have reason to believe or suspect that this password or User ID has been compromised.
  • You are solely responsible for any unauthorized use of the site conducted via your password and User ID.
  • We are not responsible for the functionality or security measures of any third party.

Children’s Privacy

  • The site is intended for use by adults in the United States.
  • Protecting the privacy of young children is especially important to us and for that reason, we do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register with the site.
  • No one under age 13 is allowed to provide any personal information to us or on the site.

Kinoma Software Privacy Statement

In this section, the Kinoma Software Privacy Statement (“Privacy Statement”), we, Kinoma, Inc., provide information about how we collect personally identifiable data from you, a user of Kinoma Play, Kinoma Create, or Kinoma Simulator (collectively, the “Kinoma software”). This section is separate from the Kinoma Website Privacy Policy.

This Privacy Statement covers only data collected by Kinoma software, and not any other data collection practices of network services or software that you access using Kinoma software or data that we or our partners collect offline or through web sites, products, or services that do not display a direct link to this Privacy Statement.

Types of Data Collected

License Data. When you activate Kinoma software, it will send a unique identifier to us to verify that you are running a valid and licensed copy of our software.

Kinoma software use. We collect aggregate usage statistics for Kinoma software, and use this information to improve our software. You can opt out of the collection of this anonymous information by turning off “Log Activity” in Network Settings.

Kinoma Guide Usage. We collect aggregate usage statistics for Kinoma Guide, and use this information to improve Kinoma Guide. You can opt out of the collection of this anonymous information by not installing Kinoma Guide.

Bug Reports. You may be prompted to send information to help us diagnose crashes or errors with Kinoma software. If you do not wish to send such information, you may decline when prompted.

Kinoma Website Privacy Policy

We will treat your personal information collected by the Kinoma software in accordance with the Kinoma Website Privacy Policy, but the Kinoma software will not collect any data other than described in this Privacy Statement.
